Terms and Conditions of Charter & Hire

Effective immediately.
By confirming a booking, paying a deposit, or using our services, you acknowledge and agree to be bound by these Terms and Conditions. Sunrise Tours operates in accordance with all applicable laws, including Transport for NSW requirements, the Passenger Transport Act 2014 (NSW), and all relevant road safety regulations.
The latest version of these Terms and Conditions is available on our website and may be updated at any time without notice.

1. Passenger Conduct

1.1 The driver is responsible for the safe operation of the vehicle at all times.
1.2 The Hirer is responsible for the conduct of all passengers and is liable for any loss, damage, or additional cleaning costs caused by passengers.
1.3 Sunrise Tours may charge the Hirer for damage, repair costs, cleaning fees or other expenses arising from passenger behaviour.
1.4 Smoking, vaping and e-cigarettes are strictly prohibited inside all vehicles in accordance with NSW law. Smoking outside must occur at least 4 metres from the vehicle.
1.5 The driver may refuse to carry any passenger who is intoxicated, aggressive, abusive, or poses a safety risk.
1.6 The driver may terminate a charter immediately if passengers engage in unsafe, unlawful, or disruptive behaviour. No refund is payable, and Sunrise Tours accepts no liability for resulting inconvenience or expense.
1.7 Passengers must not tamper with or interfere with any vehicle equipment or fittings.
1.8 The Hirer must inspect the vehicle before departure and raise any concerns with the driver immediately.

2. Food and Beverage

2.1 No food or drink may be consumed onboard, except for bottled water. NSW legislation prohibits eating or drinking on public passenger vehicles unless medically required or otherwise approved.
2.2 Passengers must remain seated while the vehicle is moving. Limbs or personal items must not be extended outside the vehicle.
2.3 All rubbish must be removed upon departure. A cleaning fee of $88 (incl. GST) applies if the vehicle is left in an unreasonable condition.
2.4 The Hirer is liable for additional cleaning, repair costs, penalties, fines or related expenses.

3. Alcohol

3.1 Consumption of alcohol onboard is strictly prohibited.
3.2 Sunrise Tours does not provide party bus services.
3.3 Alcohol (unopened) must not be carried onboard without prior written approval. Any permitted unopened alcohol must be secured and stored by the driver.

4. Additional Charges

4.1 Any itinerary changes requested by the Hirer that increase kilometres or travel time will incur additional charges. Tolls, parking and entry fees are not included unless stated otherwise.
4.2 Unexpected costs incurred during the service (e.g., waiting time, fines, extra cleaning) are payable by the Hirer.
4.3 The Hirer must nominate a safe and legal pickup location. Fines incurred due to illegal or unsafe stopping points (clearways, no-stopping zones, etc.) may be passed on to the Hirer.
4.4 A 15-minute grace period applies from the scheduled pickup time. After this time, waiting charges apply from the original scheduled time.
4.5 Waiting time is charged in 15-minute increments:

  • $30 per 15 minutes – minibuses
  • $50 per 15 minutes – coaches
    6 Sunrise Tours may debit the Hirer’s credit card or deduct from any bond to recover charges for damages, waiting time, cleaning, fines, penalties or other costs.
    4.7 The Hirer is responsible for all passenger behaviour. Fines arising from misconduct may be passed on to the Hirer.

5. Cancellations, Charges and Refunds

5.1 If the vehicle has departed the depot and the service is not used, the booking will be deemed a non-cancelled service and full charges apply.
5.2 If the Hirer fails to present within 45 minutes of the scheduled pickup time, the service will be terminated and treated as a non-cancelled service.
5.3 Failure to make payment prior to service (where required) is treated as a non-cancelled service and full charges apply.
5.4 Cancellations must be submitted in writing via email. Failure to pay does not constitute cancellation.
5.5 Cancellation fees apply as follows:

  • Within 48 hours: 100%
  • 3 days prior: 70%
  • 4 days prior: 50%
  • 5 days prior: 35%
  • 6 days prior: 20%
  • 7 days prior: 10% or forfeited deposit (whichever is greater)
    6 In the event of mechanical failure, Sunrise Tours will refund only the unused portion of the charter fee. No liability is accepted for consequential loss (e.g., missed events, accommodation, tours).
    5.7 The Hirer is liable for any third-party supplier costs associated with a cancelled booking.

6. Tentative Bookings

6.1 Tentative bookings are held for three (3) days.
6.2 A tentative booking is confirmed only upon payment of a 20% non-refundable deposit.

7. Quotes

7.1 Quotes are valid for 14 days.
7.2 Quotes may vary if the Hirer amends itinerary or service requirements.

8. Payments

8.1 Bookings made more than 7 days before service require a 20% non-refundable deposit, unless agreed otherwise in writing.
8.2 Full payment is required at least 7 days prior to the charter unless alternative arrangements are made in writing.
8.3 Bookings made within 7 days of service must be paid in full at the time of booking.
8.4 Failure to pay by the due date may result in cancellation, treated as a non-cancelled service.
8.5 Late payments may attract 10% compound interest per calendar month.
8.6 All debt-recovery costs (including agency fees and legal expenses) are payable by the Hirer.
8.7 The Hirer remains personally liable for all amounts payable.
8.8 Accepted payment methods: Visa, Mastercard, AMEX, JCB and Electronic Funds Transfer (EFT). All credit card payments are processed through Square payment system
Cash and cheques are not accepted.

8.1 Additional Payments

8.1.1 A security bond may be required for certain bookings.
8.1.2 The Hirer authorises Sunrise Tours to debit their card for overtime, damage, fines, tolls, unpaid fees or additional charges.
8.1.3 The Hirer agrees to pay all legal and administrative costs incurred in recovering unpaid amounts.

9. Breakdowns and Delays

9.1 Journey times are estimates only. Delays arising from traffic, weather, roadworks, accidents or events beyond our control do not constitute grounds for refund.
9.2 Delays do not entitle the Hirer to cancel or seek compensation.
9.3 Drivers will select the safest and most efficient route based on conditions at the time.

10. Driver Hours

10.1 Drivers must comply with all NSW fatigue-management, work-time and rest-break requirements. Maximum working hours are governed by law.

11. Passenger Property and Lost Property

11.1 The driver has sole discretion to determine whether luggage can be safely carried.
11.2 All luggage is carried at the owner’s risk. Sunrise Tours accepts no liability for loss or damage, including negligence.
11.3 Lost property is retained for three (3) weeks before disposal.

12. Equipment

12.1 Vehicles are inspected before service; however, substitute vehicles may be used if required and may differ from those originally quoted.
12.2 DVD or entertainment equipment is not guaranteed and depends on vehicle allocation.
12.3 Public performance of copyrighted media requires appropriate licensing.
12.4 Any required screening licence must be provided at least 48 hours before travel.

13. General Terms

13.1 Sunrise Tours may subcontract all or part of a service where necessary.
13.2 In an emergency, passengers must comply with driver directions.
13.3 The driver may alter the itinerary for safety, legal or operational reasons.
13.4 On-the-day variations are at the driver’s discretion.
13.5 By confirming a booking or paying a deposit, the Hirer agrees to all Terms and Conditions.

14. Overnight and Extended Charters

14.1 The Hirer must provide each driver with a separate private hotel room of at least 3-star standard.
14.2 Sunrise Tours may arrange accommodation on request, with costs invoiced to the Hirer.
14.3 Itinerary requirements:

  • Draft itinerary: minimum 1 week prior
  • Final itinerary: minimum 2 days prior
    4 Drivers may stay in alternate suitable accommodation as required.
    14.5 A $60 per day meal allowance applies per driver.

15. Complaints

15.1 Complaints must be submitted in writing via email.
15.2 All complaints are recorded in accordance with NSW Passenger Transport Regulations.

16. Notices

16.1 No decorations, signs or promotional materials may be affixed to the vehicle without prior written approval.
16.2 The Hirer is liable for costs associated with installing or removing signage.

17. Governing Law

This agreement is governed by the laws of New South Wales, Australia, regardless of the Hirer’s location.

18. Force Majeure

Sunrise Tours is not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, industrial action, accidents, government orders, or other unforeseen circumstances.

19. Limitation of Liability

19.1 Sunrise Tours is not liable for indirect, incidental, special or consequential loss, including loss of profit or opportunity.
19.2 Our maximum liability is limited to the charter fee paid for the affected day.

20. Price Changes

Prices may vary where:

  • fuel prices rise,
  • changes in law require additional costs,
  • market or operating conditions change, or
  • the Hirer’s final itinerary differs from the original quotation.

21. Prohibited Items

The following items are not permitted onboard:

  • Decorations
  • Alcohol
  • Smoking, vaping, e-cigarettes
  • Glass containers
  • Golf shoes or spiked footwear
  • Fuel containers
  • Generators
  • Illegal substances

22. Entire Agreement

This document constitutes the entire agreement between the parties and supersedes all previous verbal or written agreements.
